Ohio PCA (Planned Communities Act) Reference

In many of our letters and emails to residents, the board has referred to the Ohio Planned Community Law that went into effect in Ohio in 2010. The OPCL is listed in the Ohio Revised Code as chapter 5312.

The OPCL is not that long of a read, but does give specific authority to homeowners and to HOAs of planned communities like ours. It is very highly recommended to familiarize yourself with the OPCL. It is not that long, nor does it wander with alot of legal mumbo-jumbo.

That being said, the updates to our documents take many cues from this law, and in some cases quote sections verbatim. To be compliant with this ORC, our legal documents must be updated. The Bretton Ridge Board of Trustees asks that all residents familiarize themselves with this relatively new law. It is important to understand that Ohio Law supersedes our documents in many cases.
